२३ पुस, काठमाडौं – सर्वोच्च अदालतले द्वन्द्वकालीम मुद्धामा जन्मकैदको सजाय सुनाइएका एमाओवादीका पूर्व सभासद बालकृष्ण ढुंगेलले आममाफी दिन नमिल्ने फैसला सुनाएको छ । बाबुराम भट्टराई नेतृत्वको तत्कालीन सरकारले आममाफीको सिफारिस गरेपछि परेको रिटमा संवैधानिक इजलासले बिहीबार फैसला सुनाएको छ , सर्वोच्च अन्तरगतको संवैधानिक इजलासले ढुंगेललाई आममाफी दिन गरेको सिफारिस बदर गरेको छ । साथै यथाअवस्थामा आममाफी नदिन सरकारको नाममा परमादेश जारी गरेको छ । फैसला कार्यान्वयनको प्रक्रिया नै सुरु नभएको तथा अदालतबाट दोषी ठहरिएका ढुंगेलले सर्वोच्चको फैसला अनुसार आत्मसमर्पण नगरेको अवस्थामा ढुंगेललाई माफी दिन नसकिने अदालतको आदेशमा उल्लेख छ । कानूनले निर्धारण गनेको माफी मिनाहको प्रक्रिया समेत अवलम्बन नभएको भन्दै सर्वोच्चले सरकारको सिफारिस बदरको घोषणा गरेको छ ।
नयाँ संविधानको धारा २७६ मा राष्ट्रपतिले कुनै अदालत, न्यायिक वा अर्धन्यायिक निकाय वा प्रशासकीय पदाधिकारी वा निकायरे गरेको सजायलाई कानून बमोजिम माफी, मुल्तवी, परिवर्तन वा कम गर्न सक्ने व्यवस्ता छ,  फैसलामा भनिएको छ-भदभावपूर्वक कसैलाई लाभ दिने गरीइ भएको निर्णयबाट समानताको हक, स्वच्छ सुनुवाइ एवं अदालतको निर्णयकधो अन्तिमताको सिद्धान्त र कानूनको शासनको सिद्धान्त समेतको उल्लघन हुने भएकाले सजाय माफी दिने गरी भएको मन्त्रिपरिषद्को सिफारिस निर्णय कार्यान्वयन गर्न दिन मिल्ने नहुँदा त्यस्तो सिफारिस उत्प्रेषणको आदेशले बदर हुने ।’

An emotional US President Barack Obama has unveiled new restrictions on gun purchases at the White House, saying the “constant excuses for inaction” have to stop. The White House has outlined his plans for executive action, which focus on background checks. Most of the actions can be carried out without Congressional approval.

“That’s why we’re here, not to do something about the last mass shooting, but to prevent the next one,” he said. “The gun lobby may be holding Congress hostage right now, but they can’t hold America hostage,” Mr Obama said.  He gave his remarks surrounded by survivors and relatives of victims of shootings, recalling mass shootings in the US in the past few years and everyday gun violence in cities like Chicago. An emotional President Barack Obama employed all of his rhetorical skill to justify what are, in reality, executive actions that modestly expand federal regulation of firearm sales.

Standing in a room filled with victims of gun violence, he explained that the murder of schoolchildren in Newtown, Connecticut, changed him – and that he hoped it would change the country. Three years have passed since that school massacre, however, and the country hasn’t changed. While some states have toughened their laws, others have expanded gun rights and the US Congress has taken no action.

So Mr Obama did what he could, and wrapped the move in language that sounded more appropriate for a ceremony announcing the passage of sweeping legislation that, in today’s political environment, has no chance of reaching his presidential desk.

Leading Democratic candidate Hillary Clinton tweeted: “@POTUS is right: We can protect the second Amendment while protecting our families and communities from gun violence. And we have to.”

Republican candidate Senator Ted Cruz tweeted that the executive actions are unconstitutional, with a link to sign up for his campaign correspondence on a webpage that says “Obama wants your guns” with a photo of the president in an army jacket and hat. During Mr Obama’s speech, comedian Amy Schumer, cousin of New York Senator Chuck Schumer, was in the audience. Two women died in a shooting at a movie theatre in Louisiana during a showing of her movie Trainwreck. Gabby Giffords, a former congresswoman who survived a shooting, was there as well, in addition to many relatives of victims and survivors of mass shooting. – BBC News

२१ पुस, काठमाडौं -सप्तरी नर्घो -६ का राजेन्द्र गुप्ता कसैले पटाका पड्काएको आभास भएपछि घरबाट बाहिर निस्किए । ‘दिपावली, छठ सकिसकेको अवस्थामा कसले पटाका पड्कायो भन्दै उनी घर बाहिर निस्किको बताउँछन् । घरभित्र बसेका उनी टायर पड्किको होला भन्दै घरबाट बाहिर निस्केनन् । सोही ठाउँका कारी मण्डलले चाहिँ कसैको साइकलको टायर पड्किएको महसुस गरे । स्थानीय शैलेश गुप्तालाई पनि यस्तै महसुस भयो । ‘कसैको साइकलको टायर पड्केको आभास भयो’ उनले भने, “त्यसैले खासै ध्यान दिइनँ ।”‘बन्दुकबाट गोली निस्केपछि जुन आवाज आउनुपर्ने हो, त्यो आवाज नै निस्केन,’ स्थानीयहरुले भने, “तर पछि एकजना चिच्याएपछि त्यहाँ गएर हेर्दा असई सा’बलाई पो गोली लागेको रहेछ ।”
